In light of unfolding irrefutable evidence that the United States of America 2020 Presidential election was stolen by ballot harvesting and other illegal practices, and considering the lack of concern or motivation by anyone inside the federal government of that union of states to investigate or remedy the situation, the citizens of the several states of that union have found themselves living under a government which absolutely no longer maintains the consent of those governed by it.
What follows is my proposed response. The first draft of a bill which in a reasonable world would soon be introduced in at least two dozen state legislatures, preferably in a coordinated fashion on the same day, or perhaps at least within the same week. Perhaps the first week of July would be appropriate.
Amendment to State Constitution
Justification
1. Inasmuch as it has been observed by the citizens of the State of _________ that:
a. The right of individuals to choose their leaders had been established in the natural rights law of the North American continent since the 1776 Declaration of Independence and even prior to the issuance of that foundational document;
b. The federal government of the United States has been established by the consent of this and the several otherwise independent states;
c. The democratic selection of federal leadership has been promised to these several states in order to choose adequate persons to execute the delineated powers granted to the federal government by the Constitution of the United States of America;
d. The intentional primacy of the diffuse powers of the federal legislature have been, at many points since the enactment of that Constitution and to this day, usurped by the executive and judicial branches of the federal government both with and without the consent of the federal legislative body;
e. Very few limits to executive or judicial power have been observed by recent federal administrations for many decades;
f. The federal election of the Chief Executive has been shown to be being determined by fraudulent practices inside some of the several states.
g. No action has been taken by the delegated federal powers to remedy the fraudulent election practices of those several states.
Enactment
2. It shall be forthwith enacted that the independent Free State of __________ shall no longer
a. Send any legislator to any legislative body of the United States of America;
b. Participate in any electoral process associated with the current or any future established government of the United States of America;
c. Abide by any law, regulation or statute which is now, has been previously, or will be in the future enacted by the legislative body of the United States of America;
d. Comply with any past, present, or future action, regulation or order originated by any current or previous Executive of the United States or its agencies;
e. Treat as binding or as precedent any past, present, or future jurisprudence flowing from the judicial system of the federal government of the United States of America nor from any other of its several states and territories;
f. Pay any tax levied by the federal government of the United States of America, including any tax imposed upon private corporations or the individual citizens of the Free State of _________;
g. Allow intrusion upon the sovereign territory of the Free State of _________ by any officer of the federal government of the United States of America or any other of the several states for the purpose of enforcing any law, regulation, or statute of that government upon the government, private corporations, or individual citizens of the Free State of _________.
Ratification
3. This amendment shall be ratified by the approval of at least 2/3 of those eligible citizen electors choosing to vote in a special election, which shall be scheduled within a twelve month period after passage of this act by the legislature of the State of _________, which shall be conducted in a secure manner as follows:
a. To prevent, to the greatest extent possible, out of state political interference in the matter, no non-resident or recent immigrant to the State of _________ shall be permitted to participate in this special election by voting or by tampering with eligible voters in any way.
b. Only residents meeting a five year minimum residency requirement in the State of _________ from the date of original introduction of this amendment in the state legislature, as well as any returning resident who was native born in the State of _________ and who signs a binding agreement, under penalty of perjury, to retain their residence within the state for a minimum of five years after the special election, shall be permitted to vote in the special election.
c. A special voter registration shall be opened for a period of not less than six months following the passage of this act by the state legislature and concluding at least one month prior to the special election in order to establish an orderly registry of eligible voters as well a judicial challenges to eligibility of voters registered per the requirements of this act.
d. All voter registration documents shall immediately become public record, and may be challenged by other eligible voters if fraudulent registration is suspected. Any registrant found to have fraudulently registered for the special election or any registrant found to be engaging in spurious, unfounded allegations of fraud shall be penalized on the basis of perjury by the Supreme Court of the State of _________.
e. Only in person, paper ballot voting shall be allowed for the special election, and blind signature matching shall be required in order to release a ballot to any registered voter.
f. All special election voting shall take place on a single day, which does not coincide with any other statewide or national election or primary election. The day of the special election shall be declared a bank holiday throughout the state in order to allow maximum participation. Employers are encouraged to remain closed or to schedule only non-registered employees for work, and all registered voter employees shall be permitted time away from work for the purpose of voting in person without penalty of employment.
g. To prevent outside tampering with this process through bribery or other means, no Governor’s veto right shall apply to the passage of this act by the legislature not to the passage of the amendment as result of the special election.
h. The special election shall be conducted using a single item Yes/No ballot to answer the following question:
“Should the State of _________ rescind consent to be governed by the federal government of the United States of America and declare itself to be independent from all rule by and obligation to those powers.”
Resolution
4. Upon enactment of this amendment, the state legislature, executive, and judiciary shall each act swiftly and as empowered by the Constitution of the State of _________ to rectify the following emergent issues related to newly independent governance:
a. The assessment (including depreciation) of all property belonging to the federal government of the United States of America within the boundaries of the Free State of _________ in order that just compensation may be paid to the United States Treasury;
b. The settling of all outstanding accounts of the State of _________ with all departments of the federal government of the United States of America;
c. Rectification by amendment of any shortcomings in the language of The Constitution if the State of _________ which might endanger the citizens of the Free State of _________ by future state government overreach, including the right of individual or community secession from its rule;
d. A new or expanded executive agency for the purpose of developing diplomatic relations with the several states remaining within the United States of America, those other states who have made themselves independent of that Union, as well as any other foreign entity, union, or treaty organization which recognizes the sovereignty and independence of the Free State of _________;
e. The necessary regulatory continuation or cessation required to ensure a fair and reasonable transition of authoritative governance for all public and private business activity within the Free State of _________.
5. This act shall be passed with the following non-binding provisions, which shall guide the governance of the newly independent Free State of _________:
a. A free monetary system is foundational to a free society. No currency shall be issued by the Free State of _________. A free market in monies shall be available to all citizens, and any monetary unit trusted by both parties to an agreement may be used to settle accounts including, but in no way limited to, precious metals, independently issued bank notes, foreign currencies (including United States Federal Reserve Notes), digital currencies, and barter.
b. Limited government, whose power comes only from the consent of those under its authority, is the only moral system for rule of man by men. No governing authority in the Free State of _________ shall violate any law imposed upon or individual right inherent to any citizen, and shall be declared unfit to continue in office or receive any compensation if such violation is proven as declared by jury trial or public referendum.
c. An open immigration policy, especially with respect to those United States citizens who wish to leave that tyrannical system, shall be established in the Free State of _________. However, no right to representation, social welfare payments, or franchise in state wide elections shall be granted to any non-native immigrant until a minimum continuous residency period of at least 10 years has passed.
d. The right of self-determination of Free individuals shall be held in high regard, and as such no policies of prohibition, confiscation, or behaviorism shall be imposed upon the citizens on the Free State of _________.
What do you think? What would you change? In the late 1700s, collaboration on the Declaration of Independence and the US Constitution required great sacrifice to travel across the continent to convene, and therefore was conducted by the elites of the day. Today, the entire world can collaborate in an instant as we sip our coffee in our own living rooms. It only takes someone starting the process.
Consider this the start.
It would be great if some states considred some of these points and made some bold moves towards rejecting the legitimacy of the federal government as it now stands; I'd love to live in a state that would make that move; however, it would have to be done knowing full well the wrath that would be brought upon that state and its people. Might be a good idea to encourage local militias to arm up first. There will be enemies within the state that will try to sabotage such a move, and let's face it, it's not even a state going against our federal government. The problem is way past that point; it would be our state against the NWO. As an anarchist, one has to wonder if this move, while perhaps seemingly a move in the right direction, is really something to look to as a 'solution' to the obvious tyranny of government. A couple of years ago, summer of 2019, I'd have been all for this...now it almost seems like to much, to little, to late; but still it's always better to die on one's feet than live on one's knees.
